RULINGS ON THE MOTIONS IN LIMINE IN ADVANCE OF THE FINAL STATUS CONFERENCE
The Court has considered the briefing filed and oral arguments presented by the parties. The Court rules on the Motions in Limine as follows:
1. Plaintiffs’ and Cross-Defendants’ Motion In Limine No. 1 Re: Defendants’ and Cross-Complainants’ Assertion of Privilege to Avoid Discovery is RESERVED. Defendants and Cross-Complainants contend that they will not be introducing evidence falling into this category of documents or testimony. This does not preclude Plaintiffs/Cross-Defendants from objecting to certain evidence falling into this category at trial if necessary.
2. Plaintiffs’ and Cross-Defendants’ Motion In Limine No. 2 For Order Shifting The Burden Of Proof To Defendants is DENIED.
3. Defendants’ Motion In Limine No. 2 To Exclude Evidence Not Produced In Discovery is RESERVED. Since moving parties have not listed the specific discovery that was not produced, the Court will rule on specific objections regarding evidence not produced in discovery raised at trial if necessary.
4. Defendants’ Motion In Limine No. 3 To Exclude Testimony of Client Substitutions By Defendants is GRANTED.
5. Defendants’ Motion In Limine No. 4 To Preclude Gary Carlin From Offering Evidence At Trial That He Suffers From Any Medical Conditions As A Result of Defendants’ Conduct is GRANTED.
6. Defendants’ Motion In Limine No.5 To Preclude Evidence of Laurel Haag’s Employment and Departure From Jackson Lewis is GRANTED.
7. Defendants’ Motion In Limine No. 6 To Preclude Evidence of Roger Haag’s Employment and Departure From Law Offices of Joe Lovretovich is GRANTED.
