RULING

 

The Hearing on Motion to be Relieved as Counsel, scheduled for April 6, 2023 and concerning Defendant Jung Jun Ma, is CONTINUED to April 27, 2023, at 8:30 a.m. in Department 19 of the Stanley Mosk Courthouse.

While the Declaration in Support of Attorney’s Motion to Be Relieved as Counsel indicates that Counsel for Defendant Ma served the client by mail, (see § 3(2)), the proof of service indicates the motion papers were served on Defendant Ma electronically. California Rules of Court, rule 3.1362, subdivision (d)(2) provides that “[i]f the notice is served on the client by electronic service under Code of Civil Procedure section 1010.6 and rule 2.251, it must be accompanied by a declaration stating that the electronic service address is the client's current electronic service address.” (Cal. R. Ct., 3.1362(d)(2).) Counsel for Defendant Ma did not file any declaration stating that the electronic service address in the proof of service for Defendant Ma is his current electronic service address.

Moving Counsel for Defendant Ma is ordered to file and serve all new motion papers with the new hearing date and serve them in accordance with the applicable requirements set forth in California Rules of Court, rule 3.1362, subdivision (d), and file a proper proof of service by April 11, 2023.
