The motion and amended motion papers filed on October 28, 2022, as well as the second amended motion papers filed on November 14, 2022 fail to comply with the requirements of California Rules of Court, rule 3.1362.

Specifically, Counsel failed to file and serve a proposed order using mandatory Judicial Council form MC-053 has not been filed or lodged with the court with the moving papers. (See Cal. R. Ct., 3.1362(e).)
