I.
BACKGROUND
On 06/28/24, the Court granted Defendant Lestrita
Boardman Family Trust (erroneously sued as Defendants Matthew L. Boarman and
Nancy K. Calhoun-Vye)’s MSJ and ordered counsel to file a proposed judgment of
dismissal.
On 07/01/2024, counsel filed the proposed judgment.
The instant OSC was set per the 07/30/24 Minute
Order.
The cross-complaints have been dismissed.
Thus, the Court will sign the proposed judgment
filed on 07/01/24 after correcting the date the MSJ was granted.
However, per the 09/24/24 MO, the Court accepted the
amendment to the Complaint filed on 08/06/24 adding “City of L.A.” as a
defendant.
Thus, the only remaining defendant is the “City of
L.A.”
II.
TENTATIVE
RULING
The Court signs the proposed judgment filed on July
1, 2024 after indicating on page 2, line 10 that the Motion for Summary
Judgment was granted on June 28, 2024, not May 29, 2024.
This leaves Defendant City of L.A. Plaintiff has not
filed a proof of service of the Complaint on Defendant City of L.A.
The Court sets an Order to Show Cause Re: Failure to
File Proof of Service of the Summons and Complaint [“City of L.A.”] for June
10, 2025 at 8:30A.M. in Department 19 of the Stanley Mosk Courthouse.
Clerk to give notice.
