RULING

After consideration of the briefing filed, Plaintiff Roxana Mazariegos’s unopposed Motion for Leave to Amend to File First Amended Complaint is GRANTED.

Considering Defendant’s failure to oppose the Motion, the Court does not
find that granting Plaintiff leave to file the proposed First Amended Complaint
will prejudice Defendant. Trial has not been set in the matter and the action
was filed less than one (1) year ago.

Plaintiff is ordered to formally file the First Amended Complaint within 5 court days.
