Case Number: 22STCV21164    Hearing Date: January 29, 2024    Dept: 19

1. Defendants' Motion In Limine No 2 To Exclude Any Reference To Department of Health Services' Citations And Deficiencies is GRANTED. The Court finds that the citations and statement of deficiencies, as well as  plan or correction, do not name Plaintiff Betsy Jentz and do not specifically discuss the manner of care  provided to Plaintiff Betsy Jentz. The Court finds that the citations and statements are more unduly prejudicial than probative, and there  is a high potential to confuse the jury and predetermine the case.  (Evid. Code section 352). Further, the citations and/or statement of deficiencies contain hearsay and statements of opinion that are not admissible.

2.  The Court issues a body attachment warrant for April Faye Anasco for failure to comply with the Civil Subpoena personally served on  January 10, 2024. The Court finds that April Faye Anasco is in contempt of court for failure to personally appear at the trial on January 24, 2024.   Bail is set at $500.
