Cross-Complainant Joongangilbo USA, Inc.’s unopposed Motion to Compel Cross-Defendant Kyu Kim’s Responses to Special  Interrogatories (Set One) and Sanctions In the Amount of $1,545 is GRANTED IN PART. No opposition has been filed.  Hence, Kyu Kim is ordered to provide verified responses without objections within the next 30 (thirty) days to the Special Interrogatories (Set One).  

 

The request for sanctions is also granted in part against Cross-Defendant Kyu Kim in the reduced amount of $802.50, payable to Cross-Complainant’s attorney of record within 30 days. The Court finds that Kyu Kim has engaged in the abuse of the discovery process in failing to respond to a valid method of discovery, warranting sanctions for reasonable expenses incurred by Joongangilbo USA, Inc., including appearance at the hearing and motion filing fees. (Code of Civ. Proc. sections 2023.010(d), 2023.030(a)).  The Court finds the amount imposed is reasonable, including the hourly rate charged by counsel. The Court takes into account that no formal opposition or reply were filed in reducing the amount of sanctions awarded.
