The Hearing on Motion for Leave to Amend, scheduled for June 18, 2024, is CONTINUED August 8, 2024, at 8:30 a.m. in Department 19 of the Stanley Mosk Courthouse. The Case Management Conference is also continued to August 8, 2024, at 8:30 a.m.
First, no proofs of service were filed indicating service of the papers on any party. Although Defendants American Home Improvement, Inc. and Moshe Ben-Nissan filed an opposition, the Court is not satisfied that the papers were served on Defendants Golden State Finance Authority, Ygrene Energy Fund, Inc., and Ygrene Energy Fund California LLC.
Second, although the Motion purports to attach the declaration of Jae H. Kim required by California Rules of Court, rule 3.1324, subdivision (b), no declaration has been included with the motion papers or filed with the Court. Thus, counsel for Plaintiff is ordered to file a declaration as required by California Rules of Court, rule 3.1324, subdivision (b) on all parties and file proof of service showing that the papers, including the declaration, as well as notice of the continued hearing date, were properly served on all parties.
The hearing on Order to Show Cause Re: Failure to file Proof of Service of Summons & Complaint For Defendant Wesco Insurance Co. is also continued to August 8, 2024, at 8:30 a.m.
The Court discharges the OSC as to Defendant Bennissan.
