TENTATIVE RULING

The Hearing on Demurrer - without Motion to Strike is CONTINUED to May 20, 2025 at 8:30 A.M. in Department 19 of the Stanley Mosk Courthouse.

On January 29, 2025, Defendants/Cross-Complainants  Miller Marketing Group, Inc., Ronald Miller, and Lee Miller filed a Notice of Related Case seeking to relate the instant matter with Case No. BC715275.

However, the Notice of Related Case has not been filed in Case No. BC715275 and served on the parties in that matter as required by California Rules of Court, rule 3.300(d).

The judge who has the earliest filed case must determine whether the cases must be ordered related and assigned to his or her department. (See Cal. R. Ct., rule 3.300(h)(1)(A).)

Case No. BC715275 was filed prior to the filing of the instant action. Accordingly, Judge Ruth Ann Kwan (Department 72) must rule on the Notice of Related Case.

The Court continues the hearing on the Demurrer to give Judge Ruth Ann Kwan an opportunity to rule on the Notice of Related Case.

The Court orders Defendants/Cross-Complainants Miller Marketing Group, Inc., Ronald Miller, and/or Lee Miller to  file and serve the Notice of Related Case in Case No. BC715275 within five (5) court days of receiving this order.
