Motions to be Relieved

 

            Counsel for Defendants Samuel Jinkyoo Kang and NIW USA, Inc. (“NIW”) seeks to be relieved.  Good cause having been shown, the Court orders as follows:

 

1.                  The Court grants Defendants’ counsel’s motion conditionally upon his compliance with this order. 

 

            2.         NIW is a corporation and cannot act as a self-represented party.  Therefore, the Court sets an Order to Show Cause why the answer of NIW should not be stricken for lack of representation, which would permit Plaintiff to seek entry of default and default judgment.  The OSC hearing shall be held on June 13, 2023, at 8:30 a.m., at the following location:

The parties may appear remotely or in-person.  The Court orders actual or prospective counsel for NIW to appear at the hearing, either remotely or in-person.  The Court provides notice that if an attorney who will, or may, represent NIW does not appear at the hearing, absent good cause, the Court will strike the answer of NIW, which would permit Plaintiff to seek entry of default and default judgment.

 

            3.         The Court shall hold a trial setting conference on June 13, 2023, at 8:30 a.m.  The Court orders the parties to appear, either remotely or in-person. 

 

            4.         The Court continues the hearing on Plaintiff’s motion to compel responses from Defendants’ counsel, as a judgment debtor, to June 13, 2023, at 8:30 a.m.

 

            5.         Defendants’ counsel shall serve BOTH this minute order AND the Court’s Form MC-053 orders granting the motions to be relieved upon all parties, including his clients.  Defendants’ counsel shall file a proof of service making clear that this minute order AND the Court’s Form MC-053 orders have been served on all parties, including his clients.  Once Defendants’ counsel files the proof of service making clear that he complied with this order, he shall be automatically relieved.

 

            6.         Defendants’ counsel shall provide notice in the manner directed by this minute order.
