Minute Order

            This case is set for trial on April 3, 2023.  Defendant has filed an ex parte application to advance the hearing date on a motion for terminating sanctions due to spoliation so the motion may be heard in advance of trial.  The Court does not have availability to hear this motion in advance of trial due to congestion of the Court’s calendar.  Moreover, the Court does not anticipate being available for trial on April 3, 2023, because the Court currently is presiding over a lengthy jury trial in its oldest case.  Based upon the foregoing, the Court orders as follows:

1.         Defendant’s ex parte application is denied.

            2.         The Court advances and vacates the final status conference and trial dates.  The Court shall hold a trial setting conference on May 5, 2023, at 8:30 a.m.

            3.         The Court continues the hearing on Defendant’s motion for attorney’s fees/costs to May 5, 2023, at 8:30 a.m.

            4.         The Court advances and continues the hearing on Defendant’s motion for terminating sanctions to May 5, 2023, at 8:30 a.m. 

            5.         The Court’s clerk shall provide notice.
