Petitioner’s Ex Parte Application

 

            Petitioner filed an ex parte application seeking to advance the hearings on pending discovery motions and shorten time on the briefing schedule.  The parties have scheduled an arbitration for May 24 and May 25, 2023.  (See Declaration of Jamal J. Atiba, ¶ 11 & Exh. G.)  The Court previously found that Respondent has engaged in unnecessary litigation, delaying the proceedings and reflecting “a lack of mindfulness.”  (See Court’s Minute Order, dated March 13, 2023.)  The Court agrees with Petitioner’s counsel that the arbitration will not proceed on schedule absent a speedy resolution of the outstanding discovery issues.  Therefore, the Court orders as follows:

 

            1.         Petitioner’s ex parte application is granted.

 

            2.         Respondent’s oppositions, if any, are due on or before March 31, 2023.

 

            3.         Petitioner’s reply briefs, if any, are due on or before April 4, 2023.

 

            4.         The Court advances the hearings on all pending discovery motions to April 10, 2023, at 8:30 a.m.

 

            5.         The Court provides notice that if the motions are granted, the Court will set a ten (10) day compliance period, absent good cause.

 

            6.         Petitioner’s counsel shall provide notice forthwith via email and shall file a proof of service with the Court.
