Demurrer

 

            Plaintiff Maria Zazueta (Plaintiff’) filed this wrongful termination case against Defendants Mi Pueblito San Juan Restaurant, Martin Padilla, and El Pueblo Restaurant, Inc. (“El Pueblo”).  El Pueblo was named as a defendant by way of a Doe amendment on March 2, 2021.  This demurrer was filed on October 25, 2022.  The Court did not grant a stipulation extending the deadline to file an answer or responsive pleading.  Therefore, the demurrer is untimely, and Defendant has waived any objection on the basis of ambiguity or uncertainty.  (See Stockton Newspapers, Inc. v. Members of Redevelopment Agency (1985) 171 Cal.App.3d 95, 103.)  Regardless, Defendant’s demurrer reveals that it has, in fact, obtained further information about Plaintiff’s claims through discovery.  (See Lickiss v. Financial Industry Regulatory Authority (2012) 208 Cal.App.4th 1125, 1135.) 

 

            Based upon the foregoing, El Pueblo’s demurrer is overruled.  Counsel for El Pueblo shall provide notice and file proof of such with the Court.
