Michael Travis v. Crews of California, Inc., et al., Case No. 21STCV01499

 

Defendants seek a continuance of the trial date (March 21, 2023), because they filed a motion for summary judgment on December 1, 2022, and the first available date for hearing is May 18, 2023.  Because Defendant filed the motion sufficiently in advance of trial, and the delay in hearing the motion is due to congestion of the Court’s calendar, it would be an abuse of discretion to deny the continuance.  Moreover, the Court currently has eight trials set for the week of March 21, 2023, including one case entitled to preference, so it is  unlikely the case would proceed on that date in consideration of the factors delineated in California Rules of Court, rule 3.729.  Therefore, the Court grants Defendants’ ex parte application and advances and vacates the final status conference and trial date.  The Court sets the following dates:

 

Final Status Conference:           September 8, 2023, at 9:30 a.m.

 

Trial:                                       September 26, 2023, at 9:30 a.m.

 

The discovery and motions cut-off shall be based on the former trial date (March 21, 2023).  Defendants’ counsel shall provide notice and file proof of such with the Court.
