[TENTATIVE] Order

 

           

A.        Order to Show Cause why the Court should not modify the preliminary injunction

 

The Court continued the Order to Show Cause why the Court should not modify the preliminary injunction to revoke Orbital Consulting’s super administrative privileges.  The Court provided notice that the parties should be prepared to address whether there is any reason Orbital Consulting requires these privileges, i.e., has Orbital Consulting made a forensic copy of all data; are the privileges necessary to complete the migration work; etc.  The Court declines to modify the preliminary injunction at this time and orders that Orbital Consulting may retain super administrative privileges until its work on this case is terminated in the event of further litigation over these issues. 

 

            B.        Migration Work

 

            At the hearing on June 7, 2022, William F. Odom III from Orbital Consulting represented that he had completed his extraction/preservation work of the email accounts, logs, and other data on the G-Suite, and the next step is to “migrate,” (i.e., segregate) Plaintiff’s accounts/data from Defendant’s account/data.  The Court ordered the parties to prepare and file a joint statement.  Following the Court’s review of the joint statement, the Court grants the stipulation between Plaintiff’s counsel, Tony Brown, Esq., and Militello’s then-counsel, Stephen Weisskopf, Esq.  (See Joint Statement, dated June 24, 2022, Exh. #3.)  Specifically, all of the email accounts on the parties’ list with the designations “crcdistro.com” and “cannacocorp.com” and “rosecollective.com” and “westwoodfarmacy.com” shall be migrated to Plaintiff’s new platform except for those in the name of “Shauneen” and “Marcelo.”  This migration work shall commence forthwith.

 

            C.        Motion for Reconsideration

 

            The Court has no tentative order on its own motion for reconsideration.  The Court intends to inquire whether Ms. Militello will stipulate to the following: (1) Plaintiff may file a cross-complaint raising the instant allegations in Case Number 21SMCV00789; and (2) The preliminary injunction issued by Judge Chalfant will apply to, and may be enforced in, Case Number 21SMCV00789. 

 

Ms. Militello should be prepared to address these issues.
