Emmanuel Aguilar, et al. v. 801 Properties, L.P., et al., Case No. 21STCV25010

Defendant Swinerton Builders (“Defendant”) demurs to, and moves to strike portions of, Plaintiffs’ first amended complaint.  After the demurrer and motion to strike were filed, the parties stipulated that Plaintiffs may file a second amended complaint.  Therefore, the Court orders as follows:

1.       The Court grants the parties’ stipulation.  Plaintiffs shall file the second amended complaint within ten (10) days.

2.       The Court takes Defendant’s demurrer and motion to strike off-calendar as moot.

3.       Plaintiffs’ counsel shall provide notice and file proof of such with the Court.
