Motion to Compel Further Responses

            Plaintiffs move to compel further responses to Special Interrogatories, Set Two (“SROG”) from Defendant Pacific Life Insurance Company (“Defendant”).  Plaintiff served the SROGs in October 2022, and Defendant served timely objections.  (Declaration of Matthew E. Lilly, ¶ 3.)  Plaintiffs’ counsel sent a meet-and-confer letter on December 20, 2022, at 3:22 p.m., requesting verified responses on or before December 21, 2022, at 12 Noon.  (Id., ¶ 4.)  This motion was filed on December 23, 2022.  Defendant subsequently served supplemental responses.  (Id., ¶ 6.)

            Based upon the foregoing, the Court denies the motion to compel as moot.  The Court denies Plaintiff’s request for sanctions, as he did not make a reasonable effort to meet-and-confer before filing the motion.  Plaintiffs’ counsel shall provide notice and file proof of such with the Court.
