Motion to Compel
Deposition
Previously,
Defendant and Cross-Complainant Promed Medical Supplies (“Defendant”) moved to
compel Plaintiff and Cross-Defendant Mandana Nazar (“Plaintiff”) to appear for
deposition. The Court granted the motion
and ordered Plaintiff to submit to a deposition on or before March 31, 2023. (See Court’s Order, dated February 14,
2023.) It appears that the first motion
was based on Plaintiff’s status as plaintiff, and the instant motion is based
on Plaintiff’s status as cross-defendant.
However, Plaintiff need only appear once for a deposition. (Code Civ. Proc., § 2025.610, subds. (a), (b).)
Therefore, the motion is denied as
moot. The Court denies all requests for
sanctions. Defendant’s counsel shall
provide notice and file proof of such with the Court.
