Patricia Dantzler v. Leidos Holdings, Inc., Case No. 22STCV01613

 

Plaintiff Patricia Dantzler filed a complaint asserting two causes of action—hostile work environment and intentional infliction of emotional distress—against Defendants Kim, Bjornson, and Schaeffer (the “individual defendants”).  On August 29, 2022, the Court granted a motion for judgment on the pleadings with respect to these causes of action.  The Court granted leave to amend and ordered Plaintiff to file a first amended complaint within thirty (30) days.  Plaintiff failed to do so.  It appears to the Court that Plaintiff cannot resolve the deficiencies in the complaint with respect to the individual defendants.  Therefore, pursuant to Code of Civil Procedure section 581(f) and California Rules of Court, rule 3.1320, the Court grants Plaintiff’s ex parte application and dismisses these defendants with prejudice.  Counsel for the individual defendants shall provide notice and file proof of such with the Court.
