Motion to Deem Admitted

 

            Plaintiff Robert Wendt (“Plaintiff”) moves to deem the matters specified in the Requests for Admission, Set One (“RFAs”) to have been admitted.  Plaintiff’s counsel served the RFAs on June 27, 2022.  (See Declaration of Nilofar Nouri, ¶ 2.)  The responses were due on August 5, 2022.  (Id., ¶ 4.)  Defendant responded with objections on that date.  (Id., ¶ 5 & Exh. #3.)  Plaintiff’s counsel argues that these responses were not verified.  “Unsworn responses are tantamount to no responses at all.”  (Appleton v. Superior Court (1988) 206 Cal.App.3d 632, 636.)  However, verification of Defendant’s objections was unnecessary.  (See Code Civ. Proc., § 2033.240, subd. (a).)  As such, Defendant preserved its objections to Plaintiff’s RFAs.   

 

            Based upon the foregoing, Plaintiff’s motion is denied.  Plaintiff’s counsel shall provide notice and file proof of such with the Court.
