Motions to be Relieved

            Counsel for Defendants Advanced Surgical Institute, APC, and Mohamad Afraciab moves to be relieved.  The Court orders as follows:

            1.         Good cause having been shown, the motions are granted on the condition that counsel complies with this order.

            2.         The Court issues an Order to Show Cause why the Court should not strike the answer of Advanced Surgical Institute, APC, because this defendant cannot appear without counsel.  The OSC hearing shall be held on January 23, 2024, at 8:30 a.m. at the following location:

            Stanley Mosk Courthouse

            111 North Hill Street

            Department #39 (Goorvitch, J.)

            Los Angeles, California 90012

The Court provides notice: If this defendant does not have counsel by the upcoming hearing date, or if a prospective attorney does not specially appear at the hearing, absent good cause, the Court will strike the answer of this defendant, which would permit Plaintiff to seek entry of default and default judgment.

            3.         The Court orders counsel to serve a copy of BOTH this minute order AND the Court’s signed order on Form MC-053 upon the clients. 

            4.         The Court orders counsel to file a proof of service making clear that BOTH this minute order AND the Court’s signed order on Form MC-053 were served upon the clients. 

            5.         Once counsel complies with this order, she shall be automatically relieved without further order of the Court.

            6.         Counsel shall provide notice and file proof of such with the Court.
