Motions to be Relieved

 

            Counsel for both Plaintiff and Defendant seek to be relieved.  The Court orders as follows:

 

            1.         Good cause having been shown, the Court grants Plaintiff’s counsel’s motion to be relieved on the condition that Plaintiff’s counsel serve BOTH a copy of this order and the Court’s signed order upon Plaintiff and file a proof of service making clear that BOTH orders were served.

 

            2.         Good cause having been shown, the Court grants Defendant’s counsel’s motion to be relieved on the condition that Defendant’s counsel serve BOTH a copy of this order and the Court’s signed order upon Defendant and file a proof of service making clear that BOTH orders were served.

 

            3.         The Court continues the trial setting conference to February 21, 2024, at 8:30 a.m.

 

            4.         Defendant cannot appear as a self-represented party.  Therefore, the Court issues an Order to Show Cause why the Court should not strike Defendant’s answer, which would permit Plaintiff to seek entry of default and default judgment.  The OSC hearing shall be held on February 21, 2024, at 8:30 a.m. at the following location:

Defendant may file a response on or before February 9, 2024.  The Court provides notice that if Defendant has not retained counsel, absent good cause, the Court will strike Defendant’s answer at the upcoming hearing. 

 

            5.         The Court’s clerk shall serve a copy of this order, as well as the Court’s signed orders, upon Plaintiff’s counsel and Defendant’s counsel.  Each counsel shall serve the orders upon their clients and file proofs of service making clear that BOTH orders were served.
