Ex Parte Application to Continue Trial and all Related Dates

 

            The parties have filed a joint ex parte application to continue the trial date from August 20, 2024, to November 4, 2024, as well as all related dates.  The Court is not available for trial on November 4, 2024, and the parties articulate no good cause for continuing the fact discovery deadline.  Therefore, the Court orders as follows:

 

            1.         The ex parte application is granted in part and denied in part.

 

            2.         The Court advances and vacates all dates.  The Court sets the following dates:

 

Hearing on MSJ:                    September 20, 2024, at 8:30 a.m.

 

Final Status Conference:        October 18, 2024, at 8:30 a.m.

 

Trial:                                       October 28, 2024, at 8:30 a.m.

 

The parties shall prepare and file joint trial documents on or before September 13, 2024.  The parties shall disclose all witnesses they intend to call in their respective cases-in-chief, and identify and produce all exhibits they intent to introduce in their respective cases-in-chief, on or before September 13, 2024.

 

            3.         The expert designation deadlines and discovery cut-off shall be based on the new trial date (October 28, 2024).  The fact discovery deadline shall be based on the former trial date (August 20, 2024). 

 

            4.         Counsel for Wells Fargo Bank shall provide notice and file proof of such with the Court.
