Motion for Trial Preference

Case Management Conference

 

            Plaintiff Madlyn Primack, a minor, filed this medical malpractice action against Defendants Cedars-Sinai Medical Center, Women’s Care of Beverly Hills, and Diahnn Campbell, M.D. (collectively, “Defendants”).  Plaintiff moves for a preferential trial date within six to nine months, per Code of Civil Procedure section 36(b) & (g).  Defendants join in the motion and request a trial date of October 28, 2024.

 

            Based upon the foregoing, the Court orders as follows:

 

            1.         Plaintiffs’ motion for a trial preference is granted.  The deadline for this case to proceed to trial is October 31, 2024. 

 

            2.         The Court sets the following dates:

 

                        Final Status Conference:        October 4, 2024, at 9:00 a.m.

 

                        Trial:                                       October 14, 2024, at 9:30 a.m.

 

The Court shall hear any motions for summary judgment or summary adjudication on October 11, 2024, at 8:30 a.m.  The Court finds good cause to hear these motions less than thirty (30) days before trial under Code of Civil Procedure section 437c(a)(3). 

 

            3.         The Court orders that jury fees shall be posted within ten (10) days, if they have not been posted already, or the parties will waive jury. 

 

            4.         The parties shall follow all courtroom procedures for Department #39.  The parties shall file all trial documents on or before September 26, 2024.  The parties shall identify all witnesses they intend to call in their respective cases-in-chief, and identify and produce all exhibits they intend to introduce in their respective cases-in-chief, on or before September 26, 2024.

 

            5.         Plaintiff’s counsel shall provide notice and file proof of such with the Court.
