THIS HEARING IS BEING CONTINUED.  THE FOLLOWING ORDER WILL BE ISSUED TODAY OR MONDAY MORNING.  THE PARTIES SHOULD NOT APPEAR ON MONDAY.  

 

Plaintiff served Defendant on September 14, 2023, but has not sought entry of default and default judgment, in violation of California Rules of Court, rule 3.110(g) and (h).  Therefore, the Court advances and continues the case management conference from January 29, 2024, to March 21, 2024, at 8:30 a.m.  The Court orders Plaintiff’s counsel to obtain entry of default and submit a default judgment packet on or before March 8, 2024. 

 

The Court issues an Order to Show Cause why monetary sanctions in the amount of $500 or less should not be imposed against Plaintiff Costco Wholesale Corporation and/or Plaintiff’s counsel, Michael Miretsky, Esq., for violation of California Rules of Court, rule 3.110(g) and (h) and/or this order, per the authority of those rules and Code of Civil Procedure section 583.150 and 177.5.  The OSC hearing shall be held on March 21, 2024, at 8:30 a.m. at the following location:

The parties may appear remotely or in-person.  Plaintiff’s counsel may file a response on or before March 8, 2024 and/or may address the issues at the hearing.  Plaintiff’s counsel shall provide notice and file proof of such with the Court.
