NOTICE:  The Court will hear this ex parte application on Wednesday, May 17, 2023, at 9:30 a.m. (not 8:30 a.m.) 

Plaintiffs Felix Lopez and Luis Rodriguez (collectively, “Plaintiffs”) filed this ex parte application for an order advancing the hearings and shortening time on motions to compel Defendant Kathleen Williams (“Defendant”) and Katherine Bergh (“Bergh”) to appear and answer questions at their depositions.  Trial is set for June 6, 2023, at 9:30 a.m. 

The Court grants the ex parte applications and shall hearing the pending motions at the final status conference: May 26, 2023, at 9:30 a.m.  Oppositions shall be filed on or before May 22, 2023.  Any reply briefs shall be filed on or before May 24, 2023.  The parties shall email courtesy copies of oppositions and reply briefs to chambers: SMCDept39@LACourt.org.  The Court provides notice that if it grants the motions, it intends to order the depositions to proceed during the week of May 29, 2023.   

The Court orders the parties to file all joint trial documents on or before May 22, 2023, at 9:00 a.m.  The list of joint trial documents is located on the Court’s website: www.LACourt.org.  The list is located under the “Civil” tab, on the left side of the page under the “Courtroom Information” tab. 

Plaintiff’s counsel shall provide notice and file proof of such with the Court.
