SUMMARY
OF ACTION
Plaintiff
Daylene Moss alleges the existence of a prescriptive easement across the
property of Defendant Martha Satrasteghi and Horacio Martinez.
On
July 31, 2019, Plaintiff filed a complaint for determination of a right to
prescriptive easement. On September 6,
2019, the clerk entered defaults against Defendants. The parties stipulated to
set aside the defaults on November 26, 2019. Defendants answered On January 15,
2020.
On
August 19, 2022, the court entered judgment in favor of Defendants. On September
13, 2022, the court denied the motion for new trial.
RULING: Granted.
Counsel
moves for leave to withdraw as counsel of record for defendants Horacio
Martinez, Martha Satrasteghi, and Dam & M Investments, LLC, due to defendants’
refusal to execute a substation of attorney.
The
application complies with all procedural requirements. Withdrawal becomes
effective upon service of a completed signed order. The corporate entity may
not appear before the court without counsel.
