OF ACTION
Plaintiff
Amber Day rents certain premises in Agua Dulce owned and/or managed by
Defendants Linda Stanley Burns, Charles Stanley and Joe Cox. [Comp., Ex. A.]
Plaintiff alleges the premises are maintained in a substandard condition,
including plumbing and external water leaks, improper electrical wiring, mold
rubbish, as well as vermin, insect and rodent infestation.
On
November 16, 2020, Plaintiff filed a complaint for Tortuous Breach of Warranty
of Habitability, Breach of Covenant of Quiet Enjoyment, Nuisance, Business
& Professions Code section 17200, Negligence, Breach of Contract and Intentional
Interference with Estate. On June 3, 2021, the court overruled the demurrer of
Defendants. Defendants answered on September 28, 2021.
RULING: Granted.
Counsel
for Plaintiff moves to be relieved, due to the breakdown of the attorney client
relationship.
The motion is
granted.
Order
not effective until service on the clients of an individual, separate signed
order on each client. Corporate defendants may not appear before the court
without new counsel.
Trial
remains set for March 20, 2023.
