SUMMARY OF ACTION

Plaintiff/Judgment Creditor Andres Gomez alleges Defendant/Judgment Debtor, Luxe RV, Inc. violated certain Americans with Disabilities Act regulations regarding computer screen reading software for the company website.

 

On July 12, 2021, Plaintiff filed a complaint for Violation of the Unruh Civil Rights Act, and Unfair Competition Law. On may 16, 2022, the clerk entered a default against Luxe RV, Inc. On July 28, 2022, the court entered a default judgment for $11,252.32, comprised of $4,000 in damages, $5,830 in attorney fees, and $1,422.32 in costs.

 

RULING: Denied/Moot.

Judgment Creditor Andres Gomez moves to amend the judgment to enter the correct total amount of damages. The submitted judgment listed total damages as $7,252.32, when the damages in fact totaled $11,252.32—totals as $4,000 in damages, $5,830 in attorney fees, and $1,422.32 in costs. The court therefore declines to enter an order for a correction already reflected on the filed judgment. Judgment creditor may obtain a certified copy of the judgment from the court, as necessary.
