Plaintiff Helios Residential Solar Fund, LLC alleges Defendant Edward Mandroc breached a lease agreement for the use of residential solar panels.
On August 2, 2021, Plaintiff filed a complaint for breach of contract. On September 30, 2021, Mandroc, pro se, answered the complaint, and filed a cross-complaint for Breach of Contract, Fraud, negligence, and recission against Helios Residential Solar Fund, LLC, Sunpower Capital, LLC, and Sol Reliable, Inc. On January 5, 2022, Helios Residential Solar Fund, LLC, and Sunpower Capital, LLC answered the cross-complaint.
RULING: Granted.
Plaintiff, Helios Residential Solar Fund, LLC as successor in interst to Sunpower Capital, LLC moves to compel responses to Form Interrogatories (set one) from Defendant Mandroc. Plaintiff represents service of Defendant on April 29, 2022. [Declaration of Steven Booska, ¶ 3, Ex. A.]
According to Plaintiff, at the time of the filing of the motion, no responses were received. [Id., ¶ 5.] The unopposed motion is granted. Defendant Edward Mandroc is ordered to serve verified responses to form interrogatories (set one) without objections within ten days. (Code Civ. Proc., § 2030.290, subd. (a-b).)
Sanctions in the amount of $250 against Edward Mandroc, pro se. (Code Civ. Proc., § 2030.290, subd. (c).) Payable within 30 days.
One day non jury trial set for February 21, 2023.
