SUMMARY OF ACTION

On December 13, 2021, Plaintiff f Municipal Packaging, Inc. filed a complaint for Breach of Contract, Breach of Covenant of Good Faith and Fair Dealing, Common Count, Open Book Account, and Account Stated seeking to collect $230,750.02 for unpaid delivered goods. Defendants Virgin Scent, Inc., Yaakov Nourollah, Akiva Nourollah, and Osher Netkin answered the complaint on March 23, 2022.

 

RULING: Denied/Off-Calendar

Defendants, Yaakov Nourollah, Akiva Nourollah, and Osher Netkin move for summary judgment on the complaint. On March 14, 2023, Plaintiff dismissed all moving defendants without prejudice more than two weeks before the hearing date and any opposition due date. Plaintiff maintains a right to file a dismissal. (Code Civ. Proc., § 581, subd. (b)(1), (c).) Nothing in the pre-hearing, pre-opposition due date dismissal in any way precludes the voluntary dismissal, thereby requiring a hearing on the merits. The court lacks jurisdiction to consider the motion. (Gogri v. Jack in the Box Inc. (2008) 166 Cal.App.4th 255, 264-269; Franklin Capital Corp. v. Wilson (2007) 148 Cal.App.4th 187, 200–205; Zapanta v. Universal Care, Inc. (2003) 107 Cal.App.4th 1167, 1173–1174; Cravens v. State Bd. of Equalization (1997) 52 Cal.App.4th 253, 257.)

 

The motion is therefore denied and taken off-calendar.

 

Trial remains set for April 24, 2023.
