The petition presently lacks proof of publication. (Code Civ. Proc., § 1277.) The court electronic filing system shows a submitted proof of publication filed on February 17, 2023, but the proof was not scanned at the time of the tentative ruling publication cutoff. The court cannot verify the propriety of the proof, and therefore continues the hearing to March 29, 2023. If Petitioner submits proof of publication at the hearing, the court will grant the petition. Alternatively, the court will review the petition again prior to the hearing date to check on the scanned item, and enter the order without further need for an appearance, IF and only if, all is in compliance. A subsequent tentative ruling will indicate whether the petition is granted, denied, or continued again.
