SUMMARY OF ACTION

On February 1, 2022, plaintiff Neftali Martinez filed a complaint for quiet title, constructive trust, and resulting trust against defendant Erica Barba. Defendant answered and filed a cross-complaint for quiet title, and declaratory relief on March 25, 2022. The dispute involves title to 11208 Tamarack Ave., Pacoima.

On February 27, 2023, the court granted the motion for summary judgment of Erica Barba on the complaint.

RULING: Granted.

Counsel for plaintiff Martinez moves to be relieved as counsel of record, due to a breakdown of the attorney client relationship/lost contact with the client. The court accepts the difficulties locating the client for purposes of service of the instant motion, and accepts service at the last known address and via e-mail.

Relief not effective until signed the signed order also served on the client at the last known address.

Trial date remains set for August 21, 2023, as to the cross-complaint.
