Plaintiff Clearpath Federal Credit Union alleges Anushavan Harutyunyan passed away with an outstanding debt of $40,864.92 owed. Plaintiff submitted a claim with the Probate court, but contends Luisine Harutyunyan personal representative of the Estate of Anushavan Harutyunyan refused to address the claim, thereby leading to further collection efforts.

 

On February 21, 2020, Plaintiff filed a complaint for “Damages on a Rejected Probate Claim.” Defendant answered the complaint on May 16, 2022.

 

RULING: Granted.

Plaintiff Clearpath Federal Credit Union moves to compel responses to Request for Production of Documents (set one) served on Plaintiff Luisine Harutyunyan personal representative of the Estate of Anushavan Harutyunyan.

 

Defendant represents service of Plaintiff on May 16, 2022. [Declaration of Alana Anaya, ¶ 2, Ex. A.] According to Plaintiff, at the time of the filing of the motion, no responses were received. [Id., ¶ 3.]

 

The motion is unopposed. The unopposed motion is granted. Defendant, Luisine Harutyunyan personal representative of the Estate of Anushavan Harutyunyan is ordered to serve verified responses to Request for Production of Documents (set one), without objections, within ten days. (Code Civ. Proc., § 2031.300, subd. (a-b).)

 

Sanctions in the amount of $250 against Defendant, Luisine Harutyunyan personal representative of the Estate of Anushavan Harutyunyan and counsel of record. (Code Civ. Proc., § 2031.300, subd. (c).) Payable within 30 days.

 

Motion to compel set for March 9, 2023.
