SUMMARY OF ACTION

On February 2, 2021, Jonathan Ball, was on the premises of the Odd Ball Cabaret parking lot, a “strip club,” when an altercation among not related parties began. Plaintiff alleges being shot by an unidentified assailant.

 

On January 26, 2023, Plaintiff filed a complaint for Negligence.

 

RULING: Off-Calendar.

Counsel for plaintiff Jonathan Miranda moves to be relieved as counsel of record for unspecified reasons. Plaintiff refuses to substitute in new counsel.

 

The court previously denied the motion due to lack of any proof of service. (Code Civ. Proc., § 1005, subd. (b).) Counsel filed a revised application on June 21 and 22, 2023, which is less than 16 court days from the date of the instant hearing. (Code Civ. Proc., § 1005, subd. (b).) The court therefore takes the motion off-calendar.
