SUMMARY OF ACTION

Plaintiff Milad Nowrozani alleges an agreement for the purchase of an Audemars Piguet watch for $28,000 from defendants Anthony Chiang and Anna Lee. Plaintiff alleges a counterfeit watch was delivered, rather than the represented timepiece. Defendants refused any refund. On February 24, 2023, Plaintiff filed a complaint for False Promise, Fraud, Conversion, Penal Code section 496, and Business and Professions Code section 17200. Defendant Chiang, in pro per, answered the complaint on April 4, 2023.

RULING: Granted.

Plaintiff Milad Nowrozani moves to compel responses to Request for Production of Documents (set one) served on defendant Anthony Chiang.

Plaintiff represents service of request for production of documents on April 13, 2023. [Declaration of Clay Wilkinson, ¶ 3, Ex. 1-2.] According to Plaintiff, at the time of the filing of the motion, no responses were received. [Id., ¶ 4.]

The motion is unopposed. The court electronic filing system shows no reply filed at the time of the tentative ruling publication cutoff. The unopposed motion is granted. Defendant Anthony Chiang is ordered to serve verified responses to request for production of documents (set one) without objections within ten days. (Code Civ. Proc., § 2031.300, subd. (a-b).) Sanctions in the amount of $250 against defendant Anthony Chiang, in pro per, and payable within 30 days. (Code Civ. Proc., § 2031.300, subd. (c).)
