TENTATIVE¿
¿
The Court excuses the personal appearance of Claimant and
the guardian ad litem. Counsel may
appear by telephone or video conference call.¿¿
On July 6, 2023, the Court issued a minute order continuing the petition
to confirm compromise of minor X.M., age 15, to August 3, 2023. The Court found the settlement is reasonable,
however counsel has not shown how the medical expenses were covered. If there was an agreement to waive medical
expenses, counsel must file a copy of that agreement. The Court ordered counsel to file a copy of
the reduction agreement for medical expenses.
On August 3, 2023, the Court issued a minute order continuing the
petition again to August 25, 2023. The
Court noted that counsel has yet to file a copy of the reduction agreement for
medical expenses and ordered counsel to do so.
Plaintiff has complied and filed correspondence from The Rawlings Company
on behalf of Kaiser Foundation Health Plan, Inc. confirming they are closing
this file and no longer pursuing reimbursement.
Therefore, the Court GRANTS the petition to confirm minor’s compromise.
Moving party is ordered to give notice.
