Petition to Approve Compromise of Disputed Claim of a Minor (Annie Tapia, Age 16)
TENTATIVE
The Court excuses the personal appearance of the claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.
On June 2, 2023, the Court, by minute order, continued the hearing on this petition to confirm minor’s compromise and ordered that certain identified defects be addressed through the filing of a new petition, a new proposed order, and a proof service showing service on Defendant.
Petitioner has not complied with this order. Since the hearing on June 2, Petitioner has not submitted a new petition or a new proposed order.
Accordingly, the petition is DENIED without prejudice. Petitioner may file a new petition and a new proposed order seeking approval of the compromise.
The OSC re dismissal is CONTINUED for approximately 60 days. Petitioner and Petitioner’s counsel are advised that failure to complete the steps necessary to obtain approval of the proposed compromise may lead to dismissal of the action at the OSC hearing.
