The Court GRANTS the Petition to Approve Compromise of Pending Action of a Minor Kylee Jimenez, age 3.

Discussion

On August 11, 2023, the Court issued a minute order raising several deficiencies with the petitions:

With regard to Isaiah Avila, age 8, first Petitioner has not identified the total medical expenses incurred in Section 12a (1).

Second, Petitioner has not provided information about Claimant’s medical service providers in Section 12b(5)(b).

Third, there is a discrepancy in the balance to be paid to the claimant after accounting for fees and expenses. The total fees and expenses are $578.48, but Petitioner says the total is $467.50 and that the net balance of proceeds is $421.52. Petitioner also says that the balance of proceeds is $356.52 and that $356.52 is the amount to be paid to the minor by way of the guardian

With regard to Kylee Jimenez, age 3, Petitioner has not provided information about Claimant’s medical service providers in Section 12b(5)(b).

On October 12, 2023, Petitioner filed amended petitions and declarations of counsel that address and resolve the issues presented above.  As amended, the petition meets all substantive and procedural requirements.  Therefore, the Court GRANTS the petitions.
