Petition for Approval of Minor’s Compromise for Claimants Monserrath Rodriguez (Age 9), Leah Heredia (Age 12), Abraham Cordero (Age 14), and Diana Cordero (Age 17).

Tentative:

The Court excuses the personal appearance of the claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.  

The Court has reviewed the petitions filed on February 21, 2025, and finds that the following issues must be addressed before approval.

First, the petitions are signed twice by Petitioner (both as petitioner and as counsel).  Petitioner must sign on the line for Petitioner’s signature, and counsel must sign on the line for the attorney’s signature.

Second, the declaration of counsel fails to address the factors listed in California Rules of Court, rule 7.955(b) as required.

Third, as the petitions were consolidated to be heard on one day, several of the filed proposed orders on both forms MC-351 and MC-355 have the incorrect hearing date.

New petitions and proposed orders must be filed before the petitions can be approved.

Accordingly, the Court CONTINUES the hearing re Petitions for Approval of Minor’s Compromise for Monserrath Rodriguez (Age 9), Leah Heredia (Age 12), Abraham Cordero (Age 14), and Diana Cordero (Age 17) to __/__/2025 at 01:30 P.M. in Department 29 at Spring Street Courthouse.
