On June 15, 2022, Plaintiffs Goerge Bellgardt and Sylvia Bellgardt (collectively “Plaintiffs”) filed this action against Defendants A C Roofing, Farmers Insurance Company, and DOES 1 to 40 for (1) Negligence, (2) Private Nuisance, (3) Breach of Contract, (4) Breach of the Implied Covenant of Good Faith and Fair Dealing, (5) Elder Abuse, Welfare Code section 15600, et seq.

Defendant Fire Insurance Exchange, erroneously sued as Farmers Insurance Company, (“Defendant”) filed its motion for summary judgment on October 27, 2023.

On November 6, 2023, Plaintiffs dismissed Defendant.

As such, Defendant’s motion for summary judgment is DENIED as MOOT.

Conclusion

The Court DENIES as MOOT Defendant’s motion for summary judgment.

The Court will give notice.
