Hearing on Expedited Petitions for Approval of Minors’ Compromise for Claimant Noah Rosas (Age 16) and Desiree Rosas (Age 15).

Tentative

The Court previously reviewed expedited petitions filed on November 8, 2024, and identified three issues that needed to be addressed before the Court could grant the petitions:

(1)   Item 12b(5) needed to be checked.

(2)  Attachment 12 must be attached to describe the reasons for the apportionment of the settlement – including the payment to be received by Petitioner.

(3)  Petitioner is also a plaintiff and is receiving payment, Item 12b(2) must be checked, and the proposed payment must be included in Item 12b(3)

Petitioner filed a new petition for Claimant Desiree Rosas on January 9, 2025, and a new petition for Claimant Noah Rosas on January 23, 2025.

As to the petition relating to Claimant Desiree Rosas, the first and third issues previously identified by the Court have been addressed.  On the second issue, however, although an Attachment 12 is now included, it is inadequate, as it does not describe the reasons for the apportionment of the settlement.

As to the petition relating to Claimant Noah Rosas, none of the issues previously identified by the Court have been addressed.

Accordingly, the Court the hearing re Expedited Petitions for Approval of Minor’s Compromise for Noah Rosas (Age 16) and Desiree Rosas (Age 15) is CONTINUED from 01/31/2025 to __/__/2025 at 01:30 P.M. in Department 29 at Spring Street Courthouse.
