Expedited Petition for Approval of Minor’s Compromise for Claimant Emma Rossi (Age 12).

The Court excuses the personal appearance of the claimant and the guardian ad litem. Counsel may appear by telephone or video conference call.   

Petitioner filed a petition on April 21, 2025. The Court has reviewed the petition and identifies the following issues must be addressed before the Court can approve the petition. 

First, Item 19b(2) requires that, when funds are to be placed into a blocked account, “[t]he name, branch, and address of each depository [must be] specified in Attachment 19b(2).” Attachment 19b(2) does not identify the branch or address of the depository, as required. 

Second, there is an inconsistency between Items 16 and 17f of the petition (which state that the amount of the net proceeds available to claimant is $21,943.24) and item 4 of the proposed Order to Deposit Funds in Blocked Account (Form MC-355) (which states that the amount to be deposited is $5,625.00).  This inconsistency must be explained or corrected. 

Third, the petition and proposed orders list the incorrect courthouse (Stanley Mosk instead of Spring Street) and the incorrect judicial officer. 

On the Court’s own motion, the hearing re Expedited Petition for Approval of Minor’s Compromise for Emma Rossi (Age 12) scheduled for 05/13/2025 is CONTINUED to __/__/2025 at 01:30 PM in Department 29 at Spring Street Courthouse.
