This case arises from an alleged motor vehicle accident on March 18, 2022.  On August 23, 2023, Plaintiffs Guillermo Gutierrez (“Plaintiff”), Jesus Alberto Vargas Hernandez and Mario Hernandez-Barrera filed a complaint against Sarai Delreal (“Defendant”) and Does 1 through 20, asserting a cause of action for negligence.  On November 13, 2023, Defendant filed an answer to the complaint.

On November 10, 2023, Plaintiff served Defendant with discovery, including Form Interrogatories (Set One), Special Interrogatories (Set One), Requests for Production (Set One), and Requests for Admission (Set One).  (Yadegari Decls., ¶ 2 & Exhs. 1.)  Defendant never served responses.  (Id., ¶ 3.)

On January 31, 2024, Plaintiff filed an untimely opposition stating Defendant’s understanding that she had reached a settlement agreement with Plaintiff.

The Court will hear from counsel regarding whether Plaintiff and Defendant have settled and, if so, whether these motions are withdrawn.
