Judge: Steven A. Ellis, Case: BC701350, Date: 2025-02-11 Tentative Ruling

Case Number: BC701350    Hearing Date: February 11, 2025    Dept: 29

Mathurin v. Jelks
BC701350
Defendants’ Motion to Enforce Settlement Agreement

Tentative

The hearing is continued because of a defect in service.

When a motion is served by personal service, the last day for service is 16 court days before the hearing.  (Code Civ. Proc., § 1005, subd. (b).)  If the motion is served by mail, the time for service is increased by 5 calendar days.  (Ibid.)

This motion is set for hearing on February 11, 2025.  The last day for personal service of the motion was January 17, 2025.  The last day for mail service was January 12, 2025.

According to the proof of service on file with the Court, the motion was served by mail on January 17, 2025.  That is not timely.

The hearing is continued to March 18, 2025, at 1:30 pm, in Dept. 29 of the Spring Street Courthouse.

Moving parties are ordered to give notice of the new hearing date at least 16 court days in advance of the hearing (plus 5 additional calendar days if service is by mail).
