The Court excuses the personal appearance of the Claimant
Paula Judith Flores (Age 15) and the Guardian Ad litem (Petitioner Braulio
David Flores). Counsel may appear by
telephone or video conference call.¿¿
On July 7, 2023, the Court issued a minute order after
reviewing the Petition for Approval of Minor’s Compromise filed by Petitioner
on June 9, 2023. The Court declined to
approve the petition because of the following issues:
(1)
No medical bill was attached to the
petition from the City of Los Angeles Fire Department; and
(2)
The Claimant’s name was listed on the
medical records as Paula Judith Flores, but on the petition and proposed
orders, it was listed as Paula Yudith Flores.
Therefore, the Court continued the hearing on the petition
to July 24, 2023, and ordered counsel to correct the issues above.
On July 24, 2023, the Court issued a minute order which
declined to approve the petition. The
Court noted that on July 7, 2023, Petitioner’s counsel filed a declaration
testifying that Claimant’s correct legal name as it appears in her birth
certificate is “Paula Yudith Flores.” (Declaration of Alma Mejia, ¶ 3; Exhibit
1 – a copy of the birth certificate.) Counsel
further testified that some medical records attached to the petition
incorrectly spelled Claimant’s name. (Mejia
Decl., ¶ 3.) However, Petitioner did not
submit a copy of her medical bill from the City of Los Angeles Fire
Department.
Therefore, the Court continued the hearing on the petition
to August 11, 2023, and ordered Petitioner to file and serve a supplemental
declaration attaching a copy of the medical bill from the City of Los Angeles
Fire Department.
On July 24, 2023,
Petitioner’s counsel filed a declaration testifying that on July 7, 2023,
Plaintiff filed a Notice of Errata, which included a copy of the bill from the
Los Angeles City Fire Department, to correct the error. (Mejia Decl., ¶ 4.) Attached to the declaration as Exhibit B is a
copy of the Notice of Errata filed with the Court. (Mejia Decl., ¶ 4.) Upon review of the copy of the medical bill,
the Court finds Petitioner satisfied the Court’s July 24, 2023 order.
Therefore, the Court GRANTS
the Petition for Approval of Minor’s Compromise filed by Petitioner on June 9,
2023.
