BROWN v. GUZIK, 22STCV10016
TENTATIVE RULING ON DEFENDANT'S DEMURRER AND MOTION TO STRIKE

Plaintiffs are tenants of the Defendant.  The seventh cause of action in Plaintiffs' Second Amendment Complaint asserts a claim against Defendant for intentional influence to vacate the premises that Plaintiffs lease from the Defendant . Defendant has demurred to that cause of action.  The Court's tentative ruling is to overrule the demurrer.  In the Court's view, the allegations supporting the seventh cause of action in the Second Amended Complaint cure the defects that led the Court to sustain Defendant's demurrer to that cause of action in the prior iteration of the Plaintiffs' complaint.

Defendant also has filed a motion to strike specified paragraphs in the Second Amendment Complaint asserting entitlement to attorney's fees and punitive damages.  The Court's tentative ruling is to grant the motion as prayed such that an order striking the paragraphs in question will be entered.
