Tentative Ruling on Plaintiff's Motion to Compel Further Discovery Responses -- First Set of Requests for Production of Documents
It would appear from the papers filed in connection with the Plaintiff's motion that the following numbered requests for production of documents are at issue: 18, 33-43, 45, and 46.
The Court's tentative ruling as to Plaintiff's motion to compel further responses to these requests is as follows.
The motion is GRANTED as to numbers 35-39 and 46. In the Court's view, these requests seek information that is admissible into evidence or reasonably calculated to lead to the discovery of admissible evidence related to the alleged defects in the vehicle that is the subject of Plaintiff's complaint.
The motion is DENIED as to numbers 40 through 44 on the ground that these requests seek information that is not related to the alleged defects in the vehicle that is the subject of Plaintiff's complaint and that does not seem reasonably calculated to lead the discovery of admissible evidence as to those defects.
The motion also is DENIED as to number 45 because, in the Court's view, that request is so ambiguous as to be unintelligible.
Additionally, the motion is DENIED as to numbers 18, 33, and 34 on the ground that Defendant has stated that it will produce responsive documents to these requests.
Plaintiff's request for sanctions in the form of attorney's fees is DENIED.
