TENTATIVE RULING

 GRANT preliminary approval contingent on the parties addressing the following: 

1.  Revise Settlement Agreement ¶14 to be consistent with ¶15 in stating that the Release is effective on the date that Defendant fully funds the settlement.

2.  ¶20.d still makes reference to a 30 day response deadline, which is inconsistent with ¶1.l (45 days). Please resolve.

3.   Remove the reference to dismissal of the action at ¶27.b.iv.

4.   At Notice p. 5, remove the sample paragraph of opt-out language which create the implication that Class Members must use specific language to request exclusion.

The motion will remain on calendar and will be approved if these minor issues are adequately addressed in advance.
