SUCCESSFUL ANTI-SLAPP MOTION TO STRIKE PORTIONS OF SECOND AMENDED COMPLAINT |

Defendants Ana Ward,
HDSI Management, Inc., and Walton Halad Company Two, LLC (collectively,
“Defendants”) move for an order compelling Plaintiffs Willie F. McMullen, Jr., Deanna Welch, and Daijon
Carcamo to reimburse Defendants for at least
$34,081.00 in reasonable attorney’s
fees and $5,830.56 in costs incurred in connection with Defendants’ successful
Special Motion to Strike
portions of Plaintiffs’ Second Amended Complaint, and to prepare Defendants’
Motion for Award of Mandatory
Attorney’s Fees and Costs. Plaintiffs oppose.
On March 14, 2023, the Court granted
Defendants’ Ex Parte Application for an Order to Stay Case for 30 Days and
Continue Upcoming Hearing Dates to Allow for Completion of Settlement. The
Court’s March 14, 2023 minute order provides, inter alia, “[t]he parties
agree to a Stay for thirty days pending the completion of the settlement
agreement. The Court hereby stays the case in its entirety…Status Conference
Re: Settlement and Possible extension of Stay is scheduled for 04/14/23…”
Based on the foregoing, the Court continues
the hearing on Defendants’ instant motion for attorney’s fees to ______________, 2023 at 10:00 a.m.
Defendant is ordered to give notice of this
ruling.
